Before using our Fournos Theophilos website, please take some time to read the following terms and conditions that contain important relevant information. The use of this website shall constitute a presumption that you have read and agree with these Terms as well as with the Privacy Policy, as amended and in force, and that you shall be bound by them. So, if you do not agree with any of them, you should abstain from every transaction through this site.

1. General terms and conditions.

1.1 This website/online shop (hereinafter “Website” or “Webpage” or “E-shop”) belongs to the company under the name “FOURNOS THEOPHILOS SINGLE MEMBER PRIVATE COMPANY” (GEMI No 801506999), based in Metamorfosi, Attica, on 10 Drosini Street, P.C. 14452 (hereinafter “Fournos Theophilos”). 1.2 Fournos Theophilos is the sole and exclusive owner of the Website, including, without limitation, all documents, records, texts, images, graphics, accessories and the code contained therein, the general depiction of the website/application, as well as all rights (including copyright) arising from them. The copyright of the content of this Website is the intellectual and industrial property of Fournos Theophilos, unless otherwise specified, and protected by the relevant provisions of EU and international law.  All product names mentioned therein constitute trademarks of Fournos Theophilos, except for trademarks that may be indicated to be owned by other companies. Posting, copying, storing, modifying and/or distributing the Website’s content (in whole or in part), without the prior written permission of Fournos Theophilos , is strictly prohibited.

• Fournos Theophilos has made every effort to ensure the accuracy of the content at the time of publication (e.g. description of products, pricing, etc.). To the extent permitted by the applicable legislation, Fournos Theophilos shall disclaim all warranties, explicit or implicit, as to the accuracy of the information contained in the Website; therefore, Fournos Theophilos will not be held liable for any loss or damage, which may result from their use.

1.4 The use of the Website is intended only for adults and Fournos Theophilos shall bear no responsibility in case minors use the Website.

1.5 All products presented for sale shall be subject to availability. Fournos Theophilos does not provide any warranty for the availability of the products, but informs the customers, on the basis of data, upon their availability, and undertakes the obligation, in the event of a change of the data, to inform in due time about any unavailability, in which case Fournos Theophilos shall bear no further liability. The order may be partially accepted and executed. Fournos Theophilos therefore does not take any responsibility for any damages that may arise from the non-acceptance and non-execution of any order, in full or partially. Fournos Theophilos is not bound to immediately cover all quantities of products that may be on offer, or if the quantities ordered are unusually large. Fournos Theophilos may withdraw from the sales agreement and not accept an order in exceptional circumstances, for example if the product for which the order was made was sold a few minutes earlier and therefore there is no other stock. In this exceptional case, any price paid shall be immediately refunded.

1.6 Fournos Theophilos reserves the right to modify the prices of the products, at any time and without any other notice. However, orders that have already been made shall not be affected by these modifications. All prices of the products displayed on the Website include VAT, as applies in Greece.

2. Policies for online orders, payments and shipments.

2.1.  All orders are received electronically via our website by completing the relevant order form during the checkout process (Shopping cart > Checkout) and by clicking on the “Place Order” button. By clicking on the “Place Order” button you also agree that your personal data will be used to process your order, support your experience throughout the website, and for other purposes described in our privacy policy. Once the order is ready for shipment, you will be informed by email.

2.2.  The final image of the order includes a description of the products, quantity, total cost, namely price, VAT, any shipping costs.  Before finalizing the order with an obligation to pay, the user shall be required to check the details contained therein in order to be sure for the products he/she has chosen, the quantity, the final price, the method of receipt. By clicking on the “Place Order” button, the Customer expressly and unreservedly declares that, before the order is submitted, he/she is aware of: (a) the main characteristics of the products as they appear on the site, (b) the address and contact details of Fournos Theophilos, (c) the total price of the products, including VAT, any other charge and all additional shipping, delivery or mail charges as well as any other charges. Additional charges or other costs that were not made known to the Customer prior to the submission of the order or in the event that they could not be calculated prior to the order or not notified to the Customer by e-mail prior to the Order Confirmation will not be charged to the Customer without his / her prior express consent (d) the arrangements for payment, delivery, execution, as well as the time limit within which Fournos Theophilos  undertakes to deliver the goods or to provide the services; (e) where there is a right of withdrawal, the conditions, time limit and procedures for exercising that right as well as Fournos Theophilos ’s obligation to bear the cost of returning the products to Fournos Theophilos, (f) Fournos Theophilos  ’s liability conditions for real defects and lack of agreed features.

2.3 Fournos Theophilos may contact users via phone /email/ SMS or any available application for sending/receiving messages, throughout the duration up to the delivery of your order to you, for any issue related to the receipt, the processing, execution and/or transport of your order and/or payment and/or return of products or for any other relevant issue. The parties agree that this communication shall also cover the legal requirements of written information, notification, order confirmation, where and when required by law.

3. Methods of payment

3.1      Orders may be paid either upon receipt (COD) or via paypal, or via credit/debit cards. Electronic payments via credit/debit cards are processed once an order has been placed. Such payment of ordered products is effected electronically by third party providers of online transactions services that ensure their security.

3.2      The collection and processing of the payment details you send shall fall within the strict privacy policy governing your transactions. For more on the privacy policy and the protection of your personal data, please refer to the section entitled “Company policy on Personal data” of these terms. For card payments, in cooperation with the cooperating financial and non-financial organizations and points of sale, all necessary security measures shall be taken to ensure the maximum possible protection in your electronic transactions and to ensure your payments, without Fournos Theophilos retaining your card details, as the payment process shall be exclusively carried out in a banking environment.

4. Delivery

All ordered products are delivered by courier service at the address indicated by the customer in the placed order. Delivery of products is only effected within the following countries: Greece, Austria, Belgium, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom, Vatican

Delivery charges (net of VAT) and the estimated schedule are set out as follows:

We endeavour to deliver your products within the timescales set out above. Unfortunately, we are unable to guarantee that they will not be affected by unforeseen issues affecting our carriers. So, since the shipment time of orders shall depend on factors which are outside the control of Fournos Theophilos, such as any force majeure events or delays attributable to the courier companies cooperating with Fournos Theophilos , we do not issue any form of compensation, as delivery is a non-guaranteed service.

5. Cancellation – Return Policy.

5.1. Users are urged to check their orders for accuracy prior to their placement, since errors may be corrected up to the point at which users click on “Place Order” on the final page of the ordering process. For any issues, please contact us at in**@fo*****.com .

5.2. Cancellation: It is possible to cancel an order submitted through the Website, if this order has not been dispatched. If you would like to cancel your order please contact us at in**@fo*****.com .

5.3. Return of products due to defects or incorrect delivery: Fournos Theophilos makes every effort to ensure that the products are in perfect condition, with the agreed features and without any real defects, and it reserves all legal rights and obligations. However, the liability towards the final consumer for defective products or information relating to goods, which is stated on their packaging, lies with the producer of the products. The Customer is obliged, at the time of delivery, to check the status of the products sold, the intact packaging and the expiration date. If a product is found to be faulty or if the products delivered are different to the ones ordered, the Customer has to contact the Company (by e-mail) immediately after delivery. The product is replaced immediately, provided there is availability, at no cost.

5.4.  Subject to the following provisions under 5.5, users may return their order, even for no particular reason, as long as they exercise the relevant right (of withdrawal) within 14 calendar days from the date of receipt of that order. To this end, they must contact us at in**@fo*****.com and submit a relevant withdrawal form in an appropriate manner. As a model of withdrawal form they may use the one found here . Subsequently, all goods, to qualify for return, must be returned in their original condition, without having been opened and with their packaging intact, within an additional 14 days from the submission of a proper notice of withdrawal, for a refund to be carried out within the same period, depending on the method of payment selected. In this case, the users shall only be charged with the direct cost of returning the products, namely, in case of return by a courier company, the transport costs shall be borne by the users.

5.5. Due to health protection or hygiene reasons, the aforementioned right of withdrawal shall not exist in case the consumer has been supplied with products, i.e. goods that are liable to deteriorate or expire rapidly or sealed products which have been unsealed. For example, food and beverage products that bear an expiry date and may deteriorate due to improper storage and transportation conditions, shall not qualify for a return. Any consumer rights shall not be affected.

6. Company policy on personal data.

6.1 The management and protection of the personal data you provide to Fournos Theophilos to use the Website shall be governed by these terms and the Privacy policy applied by Fournos Theophilos and its associates, as well as  the relevant provisions of EU and international law on the protection of personal data.

6.2 Any personal and contact information you may provide to Fournos Theophilos is extremely important, also because it is the only way of contacting you, so please be sure that the information you provide to us is absolutely correct and updated (in case of changes please inform us). Fournos Theophilos, together with any partners, shall take every possible care to receive your correct information together with your explicit consent for the use of the information you have provided. Therefore, Fournos Theophilos and its associates shall bear no responsibility in the event that any of their contractual or legal obligations are not fulfilled correctly and/or timely, due to your sending of incorrect or not updated personal information. In particular, any notification made to the e-mail address, to the mobile phone number you have provided via SMS and/or any available application for sending/receiving messages, will be considered to be valid, even if it is not delivered to you due to an error in the details indicated by you and/or due to a technical or other failure of your server, and/or of your telephone and/or your telecommunications provider, and/or due to a change in your details (as long as you have not informed accordingly in time). In any case, you shall bear the obligation to re-update your information whenever there is a change in it.

6.3 By completing and sending the relevant form with your information through the Website you also provide, at the same time, to us and our associates, your written consent for using the information contained therein, for the purposes described in these terms and in the Privacy Policy published on our website.

6.4 Furthermore, your e-mail address or mobile phone number may, following your approval or consent, be used by Fournos Theophilos to inform you about products, offers, promotion of new products, etc. and may be notified to other persons, natural or legal, solely for these purposes, processing, on behalf of the company, and shall not be further disclosed, except in the circumstances stipulated by law, nor be the product of a commercial transaction. Fournos Theophilos shall bear no responsibility for any loss or damage caused to a user’s device, as a result of using the Website. Any links to other websites shall not belong to Fournos Theophilos, and Fournos Theophilos shall assume no responsibility for their use.

8.2 Users shall be responsible to maintain the confidentiality of their personal information used on the Website/Application (e.g. passwords and account details). Fournos Theophilos shall not be held responsible for any loss or damage users may suffer due to the users’ failure to protect their personal information. In case of modification of their personal information (e.g. mobile phone number, e-mail address) users shall bear the responsibility to inform Fournos Theophilos as soon as possible.

9. Miscellaneous.

9.1 If any term contained herein is unlawful, void or for any reason unenforceable, then that term shall be deemed to be separable and shall not affect the validity and enforceability of the remaining terms.

9.2 There may be legal provisions in other areas of the Website, which are related to their use, and which, together with these terms and conditions, shall govern their use.

9.3 Fournos Theophilos reserves the right to unilaterally change these terms and conditions from time to time. Users are asked to consult their content as often as possible. Fournos Theophilos cannot be held liable for damage caused to users due to any change to the terms and conditions.

9.4 Unless otherwise specified, the material on this Website is displayed solely for the purposes of promotion of Fournos Theophilos products and services.

9.5 The Website, as well as any of their contents and any contract concluded as a result of its use shall be governed by and interpreted in accordance with the Greek legislation. The parties agree to be subject to the exclusive jurisdiction of the courts of Athens. All contracts shall be concluded in the Greek language and all information shall be provided in the Greek or English language, but in case of differentiation, the Greek text shall be the only valid one.
